The notice period in a rental agreement is the advance notification that either the landlord or tenant must provide before terminating or vacating the tenancy.   • Residential tenancies: typically 1 to 3 months notice, depending on the state and agreement.

  • Monthly agreements: typically 1 month's notice.

What the Clause Should Specify

  • Whether notice must be in writing.
  • Mode of delivery (email, registered post, in person).
  • Date from which notice period commences.
  • Consequences of not serving notice (e.g., forfeiture of deposit).

The notice period is one of the most frequently disputed clauses in rental agreements. Tenants who leave without serving notice risk losing their security deposit; landlords who evict without notice may face legal action. Always document this clause in unambiguous, written terms.
