A peaceful enjoyment clause (also called a covenant of quiet enjoyment) is a provision in a rental or lease agreement that guarantees the tenant the right to use and occupy the property without interference from the landlord or any third party claiming through the landlord. It is a fundamental tenant protection clause.

  • Landlord entering the property without prior notice.
  • Frequent unannounced inspections or disruptions.

Even with a peaceful enjoyment clause, landlords typically retain the right to enter with reasonable notice (24–48 hours) for repairs, inspections, or emergencies. This balance should be documented clearly in the agreement.

The peaceful enjoyment clause is a cornerstone of tenant rights in any jurisdiction. In India, it is particularly important to include given the lack of codified tenancy protections in many states. Tenants should ensure this clause is explicitly stated not merely implied in their rental agreement.
