What is the National Rental Housing Policy?

The National Rental Housing Policy is a policy framework by the Government of India aimed at creating a well-structured, fair, and regulated rental housing market across the country. India's rental housing sector has historically been unorganised, dominated by informal agreements, and characterised by disputes between landlords and tenants due to outdated rent control laws. The Model Tenancy Act 2021 is the cornerstone legislation of this policy shift.

Why India Needed a National Rental Housing Policy

  • India has ~11 million vacant urban homes, many withheld by owners fearing tenant disputes under old rent control laws.
  • Old rent control acts (some dating back to 1947) made eviction extremely difficult, discouraging rentals.
  • No formal mechanism for dispute resolution, security deposits, or standard lease terms.
  • Rapid urbanisation has increased demand for rental housing, particularly from migrants and youth.
  • Rental housing contributes 28% of urban India's housing needs yet operates mostly informally.

Model Tenancy Act 2021: Key Provisions

  • Security deposit cap: Maximum 2 months' rent for residential premises and 6 months for non-residential.
  • Written agreement mandatory: All tenancies must be recorded in writing and submitted to a Rent Authority.
  • Eviction process: Clear provisions for landlord to reclaim property at end of lease; reduces fear of permanent occupation.
  • Rent Authorities: District-level Rent Authorities to handle disputes efficiently.
  • Rent Court and Rent Tribunal: Two-tier dispute resolution system replacing overloaded civil courts.
  • Subletting: Only with written consent of the landlord.
  • No arbitrary rent hike: Rent increases only as mutually agreed and documented.

The National Rental Housing Policy and Model Tenancy Act 2021 represent a long-overdue modernisation of India's rental housing market. If widely adopted by states, it has the potential to unlock millions of vacant homes, improve housing access for urban migrants, and create a professionally managed institutional rental housing sector.
