What is the new LTCG rule for property after 2024?

The Union Budget 2024-25, presented in July 2024, introduced significant changes to Long-Term Capital Gains (LTCG) tax on real estate. The key changes are: the LTCG tax rate was reduced from 20% to 12.5%, but the indexation benefit was removed for properties acquired on or after July 23, 2024. For older properties, a limited choice remains.

For Properties Acquired Before July 23, 2024

  • Seller can choose between: 20% LTCG with indexation OR 12.5% LTCG without indexation.
  • Choose whichever method gives a lower tax outgo.
  • This is a one-time option at the time of sale cannot be changed later.

For Properties Acquired On or After July 23, 2024

  • Only 12.5% without indexation applies.
  • No choice available indexation is no longer an option.

The 2024 LTCG amendments simplified the tax rate to 12.5% but removed the inflation protection of indexation for new purchases. Sellers of properties acquired before July 2024 have a transitional advantage of choosing the more favourable computation method.
