What is wrongful eviction?

Wrongful eviction is the illegal removal of a tenant from a rented property by the landlord without following the legally prescribed eviction process. It is a civil and potentially criminal offence under Indian law.

Common Forms of Wrongful Eviction

  • Changing locks or sealing the property while the tenant is away.
  • Physically removing the tenant's belongings.
  • Cutting off electricity, water, or other essential utilities to force vacation.
  • Threatening, intimidating, or harassing the tenant.
  • Evicting without a valid court or Rental Authority order.

Tenant's Remedies

  • File a complaint with the local police for criminal intimidation or trespass.
  • File a civil suit for restoration of possession.
  • Approach the Rent Authority for reinstatement.
  • Claim damages for loss of property and distress.

Wrongful eviction is a serious legal violation that exposes landlords to criminal prosecution and civil damages. Landlords who feel a tenant is in breach of the agreement should engage legal counsel and follow the prescribed eviction process shortcuts invariably lead to worse legal and financial outcomes than the lawful route.
