How does Certificate of Occupancy work?

A Certificate of Occupancy (CO) is an official document issued by a local government or building authority confirming that a newly constructed or renovated building complies with applicable building codes and is safe for occupation. It is a mandatory requirement before any property can be legally used or inhabited.

How the Certificate of Occupancy Process Works

  • Developer or builder submits a completion notice to the local authority
  • Building inspectors conduct a formal inspection of the completed structure
  • All systems including electrical, plumbing, fire safety, and structure are verified
  • The CO is issued once all inspections are passed and compliance is confirmed

Why the Certificate of Occupancy Is Important

  • Without a CO, a property cannot be legally occupied, rented, or sold in most jurisdictions
  • Banks and mortgage lenders require a valid CO before releasing funds
  • Insurance companies may deny claims for properties without a valid CO
  • Buyers should always verify the CO status during due diligence

Common Reasons a CO May Be Delayed or Denied

  • Outstanding building code violations or incomplete construction work
  • Failure of fire safety, structural, or utility inspection requirements
  • Missing documentation such as approved building plans or permits
  • Unauthorized modifications or additions made without proper permits

A Certificate of Occupancy is one of the most critical compliance documents in any real estate transaction. Buyers, investors, and developers must ensure a valid CO is in place before occupying, leasing, or transferring ownership of any property.
