Can NRIs buy agricultural land in India?

NRIs (Non-Resident Indians) are not permitted to buy agricultural land in India under the current regulatory framework governed by the Foreign Exchange Management Act (FEMA) and RBI guidelines. This restriction extends to plantation properties and farmhouses built on agricultural land, making these asset categories largely inaccessible to the NRI community through direct purchase. The prohibition is rooted in India's longstanding policy of protecting agricultural land for food security and ensuring it remains primarily in the hands of farming communities.

The Legal Restriction on Agricultural Land Purchase by NRIs

The restriction on NRI agricultural land purchases is clearly defined under Indian foreign exchange and property laws.

  • FEMA prohibition on agricultural acquisition : Section 6(3)(i) of FEMA explicitly restricts NRIs from acquiring agricultural land, plantation properties, and farmhouses through purchase or exchange
  • No general RBI permission available : unlike residential and commercial properties, no general permission exists for NRIs to purchase agricultural land :each case requires specific approval
  • State-level additional restrictions : several Indian states impose additional restrictions on non-resident and non-agriculturist land purchases beyond the central FEMA framework
  • Plantation and farmhouse inclusion : the restriction covers not just bare agricultural land but also tea, coffee, rubber, and other plantation estates as well as farmhouses on agricultural plots

How NRIs Can Legally Acquire Agricultural Land

While direct purchase is restricted, there are limited legal pathways through which NRIs can acquire agricultural land in India.

  • Inheritance from resident relatives : NRIs can legally inherit agricultural land from Indian resident relatives without requiring any special government or RBI approval
  • Gift from resident relatives : agricultural land can be gifted to an NRI by close resident Indian relatives as per applicable personal law and FEMA provisions
  • Special government approval route : in exceptional cases, NRIs can apply to the RBI or appropriate government authority for specific permission to purchase agricultural land
  • Conversion of inherited land : NRIs who inherit agricultural land and wish to convert it to non-agricultural use must follow state-specific land conversion procedures

What NRIs Can Do with Inherited Agricultural Land

NRIs who legally acquire agricultural land through inheritance have specific rights and obligations regarding the use and management of such properties.

  • Retention and leasing rights : inherited agricultural land can be retained and leased to resident farmers for cultivation income, subject to applicable state tenancy laws
  • Sale to eligible buyers : NRIs can sell inherited agricultural land to eligible buyers, typically resident Indian citizens who qualify under state land reform laws
  • Repatriation of sale proceeds : proceeds from the sale of inherited agricultural land are repatriable abroad subject to RBI conditions and income tax compliance
  • Land use conversion application : NRIs may apply for conversion of agricultural land to residential or commercial use as per state government land use regulations

While NRIs face clear restrictions on directly purchasing agricultural land in India, the legal framework provides alternative pathways through inheritance and gifting that allow them to hold and benefit from such assets under specific conditions. NRIs with questions about agricultural land ownership should always consult a qualified FEMA and property law expert to ensure full regulatory compliance and protect their investment interests.
