What is a rental tribunal?

A rental tribunal is a quasi-judicial body established under state tenancy laws or the Model Tenancy Act 2021 to hear and resolve disputes between landlords and tenants. It functions as an appellate authority above the Rent Court and below the High Court.

Role of the Rental Tribunal

  • Hears appeals against orders passed by Rent Courts.
  • Can review eviction orders, rent revision decisions, and deposit disputes.
  • Provides a faster and cheaper alternative to High Court proceedings.

Hierarchy of Dispute Resolution Under MTA

  • Level 1: Rental Authority (first adjudication).
  • Level 2: Rent Court (appeal against Rental Authority).
  • Level 3: Rent Tribunal (appeal against Rent Court).
  • Level 4: High Court (final appeal on questions of law).

Rental Tribunals are a critical component of the Model Tenancy Act's dispute resolution architecture. By providing a dedicated appellate body for tenancy disputes, the MTA aims to free up civil courts and deliver faster justice for both landlords and tenants a much-needed reform in a country where tenancy disputes can last decades.
