What is a wear and tear clause in rental?

A wear and tear clause in a rental agreement distinguishes between normal deterioration of the property over time (fair wear and tear) and damage caused by the tenant's negligence or misuse. It defines what the landlord can legitimately deduct from the security deposit.

What Qualifies as Normal Wear and Tear

  • Faded paint or minor scuffs on walls.
  • Worn carpet due to regular foot traffic.
  • Minor scratches on furniture from regular use.
  • Slightly loose hinges or handles.

What Is Considered Damage (Chargeable)

  • Large holes in walls, broken tiles or flooring.
  • Stains, burns, or major scratches on surfaces.

A move-in/move-out checklist with photographs, signed by both parties, is the most effective way to resolve wear and tear disputes objectively. Many landlords now use this as standard practice before releasing security deposits.

The wear and tear clause protects tenants from being charged for natural ageing of the property, while protecting landlords against genuine damage. Insisting on a documented property condition report at both move-in and move-out is the single best practice to make this clause enforceable for both sides.
