Maharashtra Plans Digital Property Titles

Maharashtra will soon introduce a Land Titling Act for digital property titles. The new law aims to replace existing ownership records with government-backed digital titles. The proposed framework, modeled on Dubai and Singapore, will be placed before the state legislature.

A mandatory measurement policy will precede property registration, streamlining transactions. Individual vertical property cards will be issued to urban cooperative housing society owners. Together, these changes represent one of the most significant overhauls to how property ownership is recorded and verified in the state.

What Revenue Minister Bawankule Announced

Maharashtra is set to introduce a Land Titling Act that will replace the existing ownership record system with government-backed digital titles, Revenue Minister Chandrashekhar Bawankule announced on Thursday.

The proposed law, modeled on land title systems followed in Dubai and Singapore, is expected to be placed before the state legislature during the winter session.

If passed, Maharashtra will become the first state in the country to implement such a framework, setting a precedent that other states may look to replicate depending on how the rollout unfolds.

How the New Title System Will Work

Bawankule said that under the proposed system, property ownership will be established through a digital title record carrying details of the current owner, legal heirs, land records and complete property information, replacing the need to trace the entire chain of previous ownership.

He said the government-issued property card will serve as an authenticated ownership document, speaking while addressing the "Society Manch" programme organised by MLA Sanjay Kelkar and the Thane District Housing Federation.

This shift from a deed-based chain-of-title system to a government-guaranteed record is intended to reduce the scope for disputes over historical ownership claims, which have long been a source of litigation in property transactions.

A New Measurement Rule and Vertical Property Cards

The minister also announced a "measurement first, registration later" policy, under which land measurement will become mandatory before any property transaction is registered.

This is designed to ensure that the physical boundaries and area of a property match official records before any change of ownership is processed, reducing the likelihood of boundary-related disputes emerging after a sale has already gone through.

In addition, every flat owner in urban cooperative housing societies will be issued an individual vertical property card, a move aimed at streamlining ownership records and reducing disputes.

For apartment owners specifically, this addresses a long-standing gap in how India's largely plot-based land record systems have struggled to capture individual ownership within multi-unit buildings.
